Q: Hi Prudence – I have a non-compete and it says that I can’t work for a competitor within 20 miles of any of our companies current or past branches. I’m looking at a job in Austin and am currently in Chicago, my company doesn’t have a branch there now, it’s been maybe 5 years since they pulled out of that market. Do you think they could come after me? – Brian

A: Hi Brian – That’s a tough call, it appears that they could but I’d absolutely consult with an attorney. I’ve had instances where Distributors have really dug in to block an ex-employee from going to work for a competitor. It would be helpful to know if they’ve consistently enforced the non-compete with other people who have left the company. I’d really err on the side of caution and make an appointment to have that contract reviewed. Thanks, Prudence
